Tenancy Agreement Review

The Council’s tenancy agreement (rules for your tenancy) has been in place for many years and it is important that we make sure it is up to date and fit for purpose. Therefore, we are carrying out a review of the rules to make sure it takes account of changes in law and reflects best practice across the housing sector.

We are now proposing a number of changes to your rules to improve them and make things clearer for you. Every council tenant will have received a copy of the survey questions below in the form of a Preliminary Notice of the proposed changes, but you can give us your views by answering the online survey questions below.

The reasons for making the changes are:

  • The current tenancy agreement has been in use since 1999 and we need to update some of the wording we use.
  • We propose to extend the automatic right to succeed to a home to family members for all tenancies. To do this we need to remove the second succession policy. This only applies to tenants whose tenancy began before 1 April 2012.
  • The Anti-Social Behaviour, Crime and Policing Act 2014 gave the Council more powers to evict tenants for serious antisocial behaviour.
  • We need to make sure the agreement reflects up-to-date policy and practices

We want to make sure that the agreement is clear for you to understand:

  • Your rights
  • Your responsibilities
  • Our rights and responsibilities
  • What causes a breach of tenancy conditions?
  • Key issues such as fire safety, pets, garden and tree management, tenancy fraud, and confirming the identity of tenants etc.
